These terms and conditions (Terms and Conditions) govern your use of our Website, Application, Call Centre, and all related services.

1. General

1.1 By registering on our Website and/or Application, and each time you use our Services, you consent to these Terms and Conditions. Registration and use of our Services require explicit consent to these Terms and Conditions.

1.2 We reserve the right to amend these Terms and Conditions at any time. Continued use of our Services following any changes constitutes acceptance of those changes. It is your responsibility to check this agreement periodically for changes.

1.3 You will be notified of any changes via email or the Application.

1.4 By using our Services, you enter into an agreement to be bound by these Terms and Conditions. To use our Services, you must sign up, providing personal information and, if required, credit card details. Upon successful booking/registration, you will receive a personal account accessible with a password.

2. Payment

2.1 Our booking services are currently free of charge. If we introduce a fee, you will be informed and can choose to continue or terminate using our Services.

2.2 We may authorize a temporary charge on your credit card to verify it is open and in good standing. This charge will appear as ‘pending’ and will be removed after verification.

2.3 If you pay via the Website, Application, or Call Centre, we charge you for the booked trip based on estimation of the trip distance and time. You will need to contact us if you wish to reschedule or update your booking. Please note that a fee of $9.50 applies to canceled trips.

2.4 Charges are based on an estimation of trip distance and time at time of booking, there is no extra charge for tolls.

2.5 If we use a third-party payment processor, its terms, conditions, and privacy policies apply in addition to these Terms and Conditions. We are not responsible for any errors by the Payment Processor. We will use transaction details solely in accordance with our Privacy Policy.

3. Conditions of Carriage for Parcel Delivery

3.1 If you use BookMyRide Australia Parcel Delivery Service, you:

  • Warrant that the goods are not Dangerous Goods.
  • Warrant that the goods do not contain illicit substances.
  • Agree that the driver is authorized to deliver the goods to the nominated address.
  • Agree that if the recipient is not present, the goods will be returned to a BookMyRide Australia office.
  • Agree that the driver may release the goods to any person presenting as the receiver, and delivery is deemed completed with a GPS pin drop off point or photograph.

4. No Unlawful or Prohibited Use

4.1 You warrant that the information you provide is accurate and complete. We may verify the information and refuse Service without providing reasons.

4.2 You warrant not to use the Services for any unlawful or prohibited purpose. Misuse of the Service may lead to immediate termination.

5. Term and Termination

5.1 The agreement lasts as long as we provide a Service to you or you have an open account with us.

5.2 You can terminate the agreement by permanently deleting the Application, closing your user account, or ceasing to use our Services.

5.3 BookMyRide Australia reserves the right to terminate your access to the Services at any time without notice if you violate these Terms and Conditions or misuse the Service.

6. Information for Personal, Non-Commercial Use Only

6.1 Information provided by BookMyRide Australia is for personal use only and may not be sold, redistributed, or used for any commercial purpose. You may download material for personal, non-commercial use only, keeping all copyright and proprietary notices intact.

6.2 You may not use data mining, robots, screen scraping, or similar data gathering tools on our Services without prior written consent.

7. Privacy

7.1 BookMyRide Australia may collect and use personal information and technical data to provide services, software updates, product support, and other services. This information may be used to develop new products and services, respond to enquiries, seek feedback, or inform you about other products or services offered by BookMyRide Australia and its related companies. We use information that does not personally identify you to improve our products or services.

8. Liability

8.1 The information, software, products, and services provided may include inaccuracies or typographical errors. Changes are periodically made to the information. BookMyRide Australia and its suppliers may make improvements and/or changes at any time. Advice received via the Services should not be relied upon for personal, medical, legal, or financial decisions.

8.2 BookMyRide Australia and its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics provided “as is” without warranty or condition of any kind.

8.3 To the maximum extent permitted by law, BookMyRide Australia and its suppliers are not liable for any damages arising out of or in any way connected with the use of the Services, whether based on contract, tort, negligence, strict liability, or otherwise. If you are dissatisfied with any portion of the Service or these terms of use, your sole remedy is to discontinue using the Services.

9. Indemnification

9.1 By accepting these terms and using the Services, you agree to indemnify and hold BookMyRide Australia and its affiliates harmless from any claims, costs, damages, losses, liabilities, and expenses arising out of your use of the Services or violation of these Terms and Conditions.

10. Applicable Law

10.1 This agreement is governed by the laws of Victoria, Australia. You consent to the exclusive jurisdiction and venue of courts in Victoria, Australia in all disputes arising out of or relating to the use of the Services.
